Terms of Service

1. Who these terms are between
These Terms of Service ("Terms") are an agreement between you and Braydens Automations, which operates AI Website Critic ("we", "us", the "Service"). By creating an account, running an audit, or otherwise using the Service, you agree to these Terms. If you are agreeing on behalf of a company, you confirm you are authorised to bind it.
If you do not agree to these Terms, do not use the Service.
2. What the Service does
The Service analyses websites and produces a score and a written report across a published set of categories, and — on plans that include it — collects visitor analytics for websites you own or manage.
Audit scores are generated from automated measurements and machine-generated commentary. They are an informed assessment, not professional advice, a guarantee of search ranking, or a statement of fact about your website or anyone else's. You are responsible for deciding what to act on.
3. Your account
You need an account to use most of the Service. Keep your login details secure; you are responsible for activity that happens under your account. Tell us promptly if you believe someone else has access to it.
You must be at least 18 years old, and you must provide accurate information when you sign up.
4. Plans, trials and renewal
The Service has a free tier and paid monthly plans. What each plan includes — audit allowances, bulk auditing limits, and how many sites you may monitor — is set out on our pricing page and may change over time; we will not reduce what you have already paid for during a period you have paid for.
The Growth / Agency plan includes a 3-day free trial for new subscribers. You may be asked for a payment method when the trial starts. Unless you cancel before the trial ends, the plan converts to a paid monthly subscription and your payment method is charged at the then-current price. Trials are limited to one per customer.
Paid plans renew automatically each month until cancelled. You can cancel at any time from your billing settings; cancellation takes effect at the end of the current billing period, and you keep access until then. Prices are in US dollars and exclude any taxes we are required to collect.
5. Refunds
Refunds are limited to the most recent monthly payment. Even if you have paid for several months, only the most recent month's payment is eligible for a refund — earlier payments are not refundable.
Cancelling stops future charges; it does not by itself refund a payment already taken. Nothing in this section limits any refund right you have that cannot be waived under the law that applies to you.

6. Acceptable use
Only audit websites you own, manage, or are otherwise authorised to test, and only install our analytics script on sites you control. Do not use the Service to attack, overload, or probe a website you have no right to test.
Do not resell or redistribute the Service itself, attempt to circumvent plan limits or rate limits, scrape the Service, or use it to build a competing product. Do not use it to break the law or infringe anyone's rights.
We may suspend or close an account that breaches this section, and we may apply rate limits or refuse a request to protect the Service.
7. Visitor analytics you collect through us
If you install our analytics script on a site, we collect page views on your behalf and show them back to you. The script does not set cookies and does not store visitors' IP addresses; visitors are counted using a salted daily hash that cannot be reversed to identify a person.
You are responsible for your own obligations to your visitors, including any notice or disclosure your local law requires, and for having the right to place the script on the site.
Collected page views are retained for a limited period and then deleted automatically. Removing a site from your account deletes the data we hold for it.
8. Your content and your reports
You keep ownership of anything you submit, and of the reports the Service generates for you — you may share them with clients, including with your own branding on plans that include white-label export.
You grant us permission to process what you submit for the purpose of providing the Service. We keep ownership of the Service itself, including its scoring rubric, software, and branding.
9. Third-party services
The Service relies on third parties, including payment processing and, where you choose to connect it, Google Analytics. Connecting a third-party account is subject to that provider's own terms, and we only request the access needed to provide the feature. You can disconnect at any time from your dashboard.
10. Availability and warranties
We work to keep the Service available, but it is provided as is and as available, without warranties of any kind to the fullest extent the law allows. We do not warrant that audits will be uninterrupted, error-free, or that acting on a report will produce any particular result.
11. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, or consequential losses, or for lost profits, revenue, data, or business, arising from your use of the Service.
Our total liability for any claim relating to the Service is limited to the amount you paid us in the three months before the event giving rise to the claim.
Some jurisdictions do not allow these exclusions, in which case they apply to you only as far as the law permits.
12. Suspension and termination
You may stop using the Service and close your account at any time. We may suspend or end access if you breach these Terms, if required by law, or if continuing would create a security or legal risk. Where it is reasonable to do so, we will tell you first.
Sections that by their nature should survive termination — including refunds, liability, and ownership — continue to apply.
13. Changes to these terms
We may update these Terms as the Service changes. When a change is material we will update the date at the top of this page and, where reasonable, tell you in the app or by email. Continuing to use the Service after a change takes effect means you accept the updated Terms.
14. Governing law
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules, and the courts located there have exclusive jurisdiction over any dispute, except where the law that applies to you says otherwise.
